Detention within a Police Station and the Rights of a Detained Person in Thailand.

If you are arrested or detained by the police in Thailand, you may be wondering what your rights are and how you can protect yourself from any mistreatment or injustice. In this article, we will explain some of the basic legal principles and procedures that apply to detention within a police station and why it is important to have legal representation by Isaan Lawyers.

According to Section 310 of the Thai Criminal Code, whoever detains or confines another person, or by any other means deprives such person of liberty of the person, shall be punished with imprisonment not exceeding three years or a fine not exceeding six thousand Baht or both.

However, there are some exceptions to this rule, such as when the detention is authorized by law, court order, or consent of the detained person.

One of the situations where the detention is authorized by law is when a person is suspected of committing a criminal offence and the police have reasonable grounds to believe that he or she may flee, tamper with evidence, harm witnesses, or commit further offences. In such cases, the police can arrest and detain the suspect without a warrant for up to 48 hours, which can be extended by another 12 hours with the approval of a public prosecutor.

During this period of detention, the suspect has certain rights that must be respected by the police. These rights include:

– The right to be informed of the reason for the arrest and detention and the charges against him or her.
– The right to remain silent and not to incriminate oneself.
– The right to contact and consult with a lawyer of his or her choice, or request a state-appointed lawyer if he or she cannot afford one.
– The right to contact and inform a relative or a person of trust about the arrest and detention.
– The right to medical examination and treatment if he or she is injured or ill.
– The right to humane treatment and not to be subjected to torture, coercion, threats, or other forms of physical or mental abuse.
– The right to challenge the legality of the arrest and detention before a court and request bail or release.
These rights are guaranteed by various sources of law, such as the Thai Constitution, the Criminal Procedure Code, the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, and the International Covenant on Civil and Political Rights, which Thailand has ratified.
In practice a suspect’s rights and or any procedures may not be applied or followed as rigorously as they may be in the home country of an overseas national, thus the importance of having an experienced lawyer by your side.
